Balloting for the Officer Elections serving the 2019 - 2022 Term will open on July 15, 2019 and close on August 15, 2019. Newly elected Officers wil begin their term on September 1, 2019.

Election and Campaign Rules

Local Union 567
1. Constitution and Bylaws
The nomination and election of TWU Local 567 officers will be conducted in accordance with the 2017
edition of the TWU Constitution, the Local 567 Bylaws revised March 26, 2013, and the Laborâ
Management Reporting and Disclosure Act of 1959.
2. Terms of Office
Candidates elected to office will serve from September 1, 2019 through August 31, 2022.
3. Eligibility to Hold Office
To be eligible for nomination and election to office, a candidate shall be a member in continuous good
standing of the Transport Workers Union of America for a period of 12 months preceding nomination, and
must have attended at least 6 regular monthly membership meetings during the 12 months preceding
nomination. If this meeting requirement prevents a majority (50 percent plus 1) of the Local 567
membership from participating in the election process, the Local 567 Executive Board shall rule it waived
for all candidates. For purposes of this election, dues must be paid through the month of June 2019 by
5:00 p.m. CDT on June 17, 2019.
No member of this Local shall be permitted to run for more than one elective office, or hold a combination
of elective and appointive office (except Convention Delegate).

4. Nomination Notice
A nomination notice will be posted at the union hall, on the TWU Local 567 website, and on union
bulletin boards at the worksite in May 2019.
5. Nominations
Nominations by separate petition for the offices of President, Vice President, Secretaryâ
Treasurer/Recording Secretary, three (3) Executive Board members, two (2) convention delegates, and
two alternates must be handâdelivered to the Election Committee or union office by 5:00 p.m. CDT on
June 17, 2019.
Petitions require a minimum of 5 percent of the signatures of members in good standing through the
month of June 2019. To be accepted, petitions must include each member’s signature, printed name, and
employee number.

6. Candidate Eligibility Determinations and Acceptances
The Election Committee shall determine the acceptability of all petitions and verify the acceptance of all
nominations.
7. Inspection of the Membership List
Each candidate may inspect the TWU Local 567 membership list once within 30 days prior to the election.
No candidate is entitled to receive a copy of the list. Candidates must contact SecretaryâTreasurer J. C.
Sampson at the Local 567 office to schedule an appointment to inspect the membership list.
8. Distribution of Campaign Literature
TWU Local 567 will honor any reasonable request by a candidate to distribute campaign literature to
members at the candidate’s expense. Use of the TWU International or Local 567 logo on campaign
material is prohibited.
9. Campaign Restrictions
Section 401(g) of the LaborâManagement Reporting and Disclosure Act of 1959 prohibits the use of union
and employer funds to promote the candidacy of any person in a union officer election. This prohibition
applies to facilities, equipment, supplies, and cash, as well as to campaigning on time paid for by either a
union or employer and to the use of the TWU Local 567 website for campaign purposes. These restrictions
are highlighted here in more detail:
ï A union or employer may not contribute money or anything of value to promote the
candidacy of any individual in a union officer election.
ï The prohibition against the use of union and employer funds applies to any union and any
employer, not just to TWU Local 567 or to the employers with whom TWU Local 567 has
collective bargaining agreements. For example, it is improper for a candidate to have
campaign literature duplicated free of charge on a copy machine at a friend or relative’s
employer.
ï Any expenditure of union or employer funds on behalf of a candidate, even if the amount is
small, is a violation of federal law.
ï The use of union or employer funds or facilities is a violation of federal law even if union
officials or the employer do not know about or approve of the use.
ï The prohibition against the use of union and employer funds applies to direct expenditures
from the union or employer and indirect expenditures such as:
• Campaigning on time paid for by the union or employer
• Use of union or employerâowned or leased equipment such as telephones, fax machines,
computers, copy machines, and vehicles
• Use of union or employer supplies such as stamps, paper, and envelopes
• Use of union employees to prepare campaign literature while on union time
• Use of the union letterhead, logo, or membership list
• Use of union or employer property or facilities to conduct campaign activities or store
campaign material

• Printing articles which support or criticize an individual’s candidacy in a union newspaper
or other publication
• Giving free services or special discounts to a candidate customer such as printing,
photocopying, or equipment rental
Federal law also provides that candidates must be treated equally regarding the opportunity to campaign
and that all members may support the candidates of their choice without being subject to penalty,
discipline, or reprisal of any kind.
10. Voter Eligibility
Membership dues are payable on the first working day of each month. Any member who fails to pay dues
for the month of July by 5:00 p.m. CDT on, July 15, 2019, shall be in bad standing and shall be ineligible to
vote in this election.
No member enrolled in dues checkoff will be declared ineligible to vote because of an alleged delay or
default in the payment of dues by the employer.
Retirees are not eligible to vote.
11. Election Notice
A notice of election will be mailed to the last known home address of each TWU Local 567 member no
later than July 15, 2019. Election notices will also be posted on the TWU Local 567 website and on union
bulletin boards at the worksite.
12. Observers
All candidates may observe and appoint one additional observer to be present at each phase of the
election process. Candidates must submit the names of their observers in writing to Election Committee
member. Paying election observers is the responsibility of the candidate they represent.
13. Election Day
Balloting will take place by internet and telephone from, July 15, 2019, through August 15, 2019. Notice
of election with account activation information and voting instructions will be mailed before the polls
open. Writeâin votes will not be permitted.
14. Tally of Ballots
The tally will be certified by the Election Committee beginning at 11:00 a.m. CDT on August 16, 2016,
in the executive board room at the local union hall. The candidate who receives the most votes cast for
each office shall be deemed elected to that office. The three candidates for executive board member with
the highest number of votes will be elected. A tie vote for any position will be resolved by a coin toss
supervised by the Election Committee.

15. Election Results
The election results will be posted at the union hall, on the TWU Local 567 website, and on union bulletin
boards at the worksite after the tally is completed. In the event of a tie vote, the winner will be
determined by a coin toss. The candidate with the lowest employee number has the option of calling the
coin toss. If more than two candidates tie, the candidates’ names will be placed into a container with an
Election Committee member randomly selecting the winning candidate.
16. Election Records
The SecretaryâTreasurer/Recording Secretary is responsible for maintaining all nomination and election
records for at least 1 year after the election as required by federal law.
17. Questions or Problems
Any violation of these rules should be reported promptly to the Election Committee so that corrective
action can be taken, if necessary. All questions or requests pertaining to this election must be submitted

18. Protests
Any TWU Local 567 member in good standing may file an election protest. All election disputes shall be
reported to the Election Committee. The Election Committee shall report its findings to a meeting of the
local Executive Board no later than August 26, 2019. The local Executive Board has 30 days in which to
rule on an election protest.
The decision of the local Executive Board may be appealed to the International Committee on Appeals
within 15 days of the decision pursuant to Article XXII of the constitution. If the local Executive Board
does not issue a decision within 30 days, the member may appeal to the International Committee on
Appeals under Article XXII of the constitution.
The above rules are not all inclusive. Additional election rules or clarifications may be issued by the
TWU Local 567 Election Committee as needed during the nomination and election period.
